FITSEE — TERMS OF SERVICE

Welcome to Fitsee! These Terms of Service ("Terms") are a legal agreement between you and American Global Nexus LLC ("Fitsee," "we," "us," or "our"). They govern your use of the Fitsee website at fitsee.ai and the Fitsee mobile app for iOS and Android (together, the "Service").

By creating an account, downloading the app, or using Fitsee in any way, you agree to these Terms. If you do not agree, please don't use Fitsee.

Please read Section 4 (Subscriptions and auto-renewal), Section 7 (Refunds), and Section 11 (Disclaimers and limits) carefully — they affect your rights, your money, and what to expect from the Service.

1. WHAT FITSEE DOES

Fitsee uses artificial intelligence (AI) to generate images that show how clothing, shoes, bags, hats, and other accessories might look on you, based on photos you upload. You add a photo of yourself plus a photo of an item, and Fitsee creates a "try-on" image.

Important: every result is an AI-generated visualization — an approximation, not an exact representation. Colors, fit, proportions, fabric, and small details can and will differ from real life. AI images can also contain glitches or artifacts. Do not rely on a Fitsee result to judge exact sizing, color accuracy, or how an item will truly look or fit. Always check the seller's own product details before you buy anything elsewhere.

Try-on results are synthetic, AI-generated images. You should not present them as genuine, unedited photographs of a real person without making clear that they are AI-generated.

2. WHO CAN USE FITSEE

• You must be at least 18 years old to create an account and use Fitsee. By signing up, you confirm that you are 18 or older.
• Fitsee is not intended for anyone under 18, and we do not knowingly allow under-18 use. If we learn an account belongs to someone under 18, we will close it.
• You must give accurate information when you sign up, and keep your login details secure. You're responsible for activity that happens under your account.

3. YOUR PHOTOS AND CONTENT

Fitsee only works because you upload photos. To keep everyone safe, you agree to the following rules:

• Only upload photos of yourself, or of another adult who has clearly given you permission to use their photo.
• You may NOT upload any image of a person under 18 — this includes yourself if you are under 18, and includes any child who appears in the background of a photo.
• You may NOT upload images that are unlawful, sexually explicit, exploitative, hateful, harassing, or that depict a real person without their consent.
• You may NOT upload content you don't have the rights to use.

These rules are zero-tolerance. Violating content can lead to immediate account termination and, where the law requires it, reporting to the appropriate authorities. We may use automated tools and human review to detect prohibited content.

Your ownership: You keep ownership of the photos you upload and the looks you save. We don't claim any rights to your content beyond what we need to run the Service for you.

Permission you give us: By uploading a photo, you give us permission to process it — including sending it to our third-party AI image provider — solely to generate your try-on result, and to store the results you choose to save in your private library. See our Privacy Policy for the full data path.

4. CREDITS, PLANS, AND SUBSCRIPTIONS

Fitsee runs on a credit system. Because more advanced try-ons cost us more to produce, different features use different numbers of credits:

• Any single item (clothing, shoes, bag, or hat): 2 credits
• Entire outfit (top + bottom, with or without shoes): 3 credits

Every try-on runs in HD quality — it's included in the credit prices above, never an extra charge.

Free credits: Every new account starts with 4 free credits, no card required. Free credits are offered at our discretion and may be limited per person, device, or account. Any unused free credits may be removed if we close an account for breaking these Terms.

Ways to buy credits (current prices): - Credit Pack — $4.99 one-time — 20 credits - Starter — $7.99 per month — 40 credits each month - Pro — $24.99 per month — 130 credits each month - Pro Top-Up — $3.99 one-time — 20 credits (available only to active Pro subscribers, as a member discount when you run low before your monthly refill)

Prices may change over time; the current price is always shown on the purchase screen before you pay.

Credit rules: - Credits have no cash value and cannot be transferred, sold, or exchanged for money. - One-time packs (Credit Pack and Pro Top-Up) do not auto-renew — you're charged once. - Subscription plans (Starter and Pro) auto-renew (see below).

4a. AUTO-RENEWING SUBSCRIPTIONS — PLEASE READ

Starter and Pro are auto-renewing monthly subscriptions. Here's exactly how they work:

• Subscription title and what's included:
• Starter — 40 credits each month for $7.99/month.
• Pro — 130 credits each month for $24.99/month (Pro members can also buy the Pro Top-Up).
• Length and price: Each subscription period is 1 month, billed at the price above.
• Automatic renewal: Your subscription automatically renews at the same price for another month unless you cancel at least 24 hours before the end of the current period.
• When you're charged: Your payment method is charged for the renewal within 24 hours before the current period ends.
• Refilled credits: Each renewal adds that month's credits to your balance.
• Cancel anytime: You can cancel whenever you like. When you cancel, you keep your plan benefits and any remaining credits until the end of the period you've already paid for — you're simply not charged again after that.

How to cancel depends on how you bought the subscription:

• If you subscribed on the web (through Stripe): Open "Manage subscription" in the app to reach our secure Stripe billing portal, where you can cancel, upgrade or downgrade, update your card, or download invoices.
• If you subscribed through Apple (in the iOS app via the App Store): Manage or cancel in iOS Settings → tap your name → Subscriptions, or in the App Store app. Fitsee cannot cancel Apple subscriptions for you, and Apple (not Fitsee) handles billing and refunds for those purchases.
• If you subscribed through Google Play (in the Android app): Manage or cancel in Google Play → Payments & subscriptions → Subscriptions. Google (not Fitsee) handles billing and refunds for those purchases.

You can always find a link to these Terms and our Privacy Policy on the purchase screen and in the app.

5. PAYMENTS

• Web purchases are processed securely by Stripe. We never see or store your full card number — Stripe handles your card details directly.
• In-app purchases on mobile may be processed by Apple (App Store) or Google (Google Play) using their own billing systems, where their rules require it. In those cases, Apple or Google is the merchant of record and handles billing, receipts, and refunds for that purchase.
• The store or processor you used determines where to go for billing help and refunds (see Sections 4a and 7).

6. ACCOUNT AND DATA DELETION

You're in control of your account: - You can delete any saved look from your library at any time. - You can permanently delete your entire account and its data from within the app, under Settings → Delete Account. You can also request deletion by emailing privacy@fitsee.ai.

Deleting your account removes your profile info, saved looks, and credit balance. Deletion is permanent — credits are not refundable on deletion (see Section 7), and we may keep limited records only where the law requires it or to prevent fraud and abuse. We complete deletion within 30 days.

Important about subscriptions: Deleting your Fitsee account does not automatically cancel a subscription billed through Apple or Google. If you subscribed through the App Store or Google Play, cancel through that store first (see Section 4a), then delete your account.

7. REFUNDS

Because each try-on uses real processing resources the moment it runs, used credits are generally non-refundable.

Exceptions: - Broken result on our end: If a try-on fails or produces a clearly broken result because of a problem on our side, contact us through the in-app Help page. If we confirm the problem, we'll refund the credits you used. - Unused pack bought by mistake: An unused one-time credit pack purchased by mistake may be refunded within 7 days of purchase, as long as no credits from that pack have been used.

If you bought through Apple or Google: Apple and Google handle refunds for purchases made through their stores under their own refund policies. Please request those refunds through the App Store or Google Play, not through Fitsee.

8. ACCEPTABLE USE

When using Fitsee, you agree NOT to: - Try to bypass credit limits, payments, or security measures. - Use Fitsee to harass, impersonate, deceive, or harm anyone. - Upload prohibited content (see Section 3). - Resell, redistribute, or commercialize Fitsee outputs without our written permission. - Reverse-engineer, scrape, overload, or interfere with the Service or the systems behind it.

We may suspend or close any account that breaks these Terms. When we close an account for a violation that is not fraud or abuse, we'll refund unused purchased credits where reasonable.

9. APP STORES

If you downloaded Fitsee from the Apple App Store, Apple's Standard End User License Agreement (EULA) also applies to your use of the app, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. To the extent these Terms conflict with that EULA, the EULA governs for the app itself. Apple is a third-party beneficiary of these Terms and may enforce them, but Apple is not responsible for the app or its content, maintenance, or support.

If you downloaded Fitsee from Google Play, your use also complies with Google Play's terms and policies.

These Terms are between you and Fitsee only — not with Apple or Google.

10. INTELLECTUAL PROPERTY

The Fitsee name, logo, app, website, and software are owned by American Global Nexus LLC and are protected by law. We grant you a limited, personal, non-transferable license to use the Service for your own non-commercial try-ons. You keep ownership of your own photos and saved looks, as described in Section 3.

11. DISCLAIMERS AND LIMITS OF LIABILITY

Fitsee is provided "as is" and "as available." AI technology is imperfect, and we do not guarantee that results will be accurate, realistic, available at all times, uninterrupted, or error-free.

To the fullest extent allowed by law: - We disclaim all warranties not expressly stated here. - Fitsee and American Global Nexus LLC are not liable for indirect, incidental, special, or consequential damages. - Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.

Some places don't allow certain limitations, so parts of this section may not apply to you.

12. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Any dispute that can't be resolved informally will be handled in the state or federal courts located in Wyoming, and you agree to that venue — unless a binding consumer-protection law in your home country or state gives you the right to bring a claim elsewhere. Before filing anything, please contact us at support@fitsee.ai so we can try to resolve it together.

13. COPYRIGHT / IP COMPLAINTS

If you believe content on Fitsee infringes your intellectual property rights, email us at support@fitsee.ai with: a description of the work, where the infringing content is, your contact information, and a statement that you have a good-faith belief the use isn't authorized. We will review and respond, and may remove content and terminate repeat infringers.

14. CHANGES TO THESE TERMS

We may update these Terms as Fitsee grows. If we make material changes, we'll update the "Last updated" date at the top and, where appropriate, give notice in the app. Continuing to use Fitsee after changes means you accept the updated Terms.
